    Hi everyone. I have a friend who has also filed the I-129F for his fieance. He told me he made a small mistake in his side of the G-325A form. He found this out after sending it and it has been about 4 months. He works with his family at a family business since march of 1998. He does not get payed by his family since it is a family business and he also is a college student so he is working at his university. Now the problem is that in his G-325A form when he listed his current employers for the last 5 years. He has listed his family business as his current employeer and his university he works for as second. Now my questions is that he does not get payed so he does not get any Tax W-2 from his family business for him but from his college he does. I told him that what he can do is reprint his G-325A and make a star by his family business and state at the bottom of the first G-325A form that the first company listed is a family business and send this with his I-134 to his Fieance when she goes to the interview. Also I forgot to say his Fieance visa for his girl has been approvved. So I told him also that he can write on the first page of the I-134 at the bottom and mention that he also works for a family business since March 1998. Becuase he has listed his university job as the job in his I-134. So what is concern is will there be any problem with his fieance getting her visa when it comes time for interview at the Indian embassy. becuase he is also fileing for his Fieance in India. he wants to know will she have any problems with getting the visa. He is also got a co-sponsor. One of his family members has a self-employed business and also his co-sponsor works. So his co sponsor has given him his tax returns and a job letter. And my friend has also got his job letter and three year tax returns. With all this said and done. Can some one please tell me will his fieance have any problem with getting the K1 Visa from the Us Embassy in India. but in his 3 year tax returns he does not have any W2 from his family business becuase he does nto get payed but he does have W2 from his university. What my friend is worrying about is that since he has listed his family business as the first from MArch 1998 to present and he has his unversity from 08/2001 to 05/2003 but he is working this last semester at his college. So he wants to know will this cause any problem with his fieance getting the visa durning the interview. He has a letter from his HR that states he was out for summer leave and has returned for this semester. So can someone please reply ASAP.

      First, I have to say I am having a little trouble following what your question is, so I apologize if I do not answer the right thing.

      Second, if I understand your friend's concern, they are worried because they feel that their G325A has an inaccuracy on it, in that it indicates that they are working for their parents, when in reality their main (i.e., paying) job is at their University. However, they are relying on their University job in their I-134. Their concern, therefore, isn't that what they said on their I-134 isn't true; it is more that it will LOOK inaccurate/be confusing in comparison to the I-134.

      If I understand your friend's concern, then I think the steps you are proposing (re-printing the G325A with a note on it explaining that this a family business and he does not get paid by them; putting a similar note at the foot of the I-134) should be fine (I would not necessarily "re-submit" the G325 with the I-134, but she can take the G-325 with her to the interview). He should also make sure that his fiancee understands the situation thoroughly in case they ask her about it.

      I don't think that the consulate is going to be overly concerned about this, and the explanation your friend is offering makes sense. The only danger is that the interviewer might get confused; a note like you suggest on the I-134 will hopefully clear up any confusion before it starts, and also will make it clear to the consulate that your friend is being very upfront and not trying to mislead them at all.

      Also, I think the fact that your friend has a co-sponsor means that the consulate is probably going to be a lot less concerned about this than they might be without a co-sponsor.

      Good luck to your friend. I think this should work out fine for them.

        Just noticed a typo: the sentence "Their concern isn't that what they said on their I-134 isn't true" should start "Their concerns isn't that what they said on their G-325A isn't true . . . . " Sorry!

          Thanks for the reply. Sorry to confuse you Ahalow if I did. But what I was trying to say is this in steps.

          1. My friend filled out the G-325A with all his info. On the G-325A form that he sent to the TSC he has stated his family business as present employer. So in the form he first listed his family business. And in the line below he listed his university he works for. He said he has worked at his university from 08/2001 to 05/2003 and this summer he did not work. But he has got a letter from HR department that states he was on summer leave from June 2003 to Auguest 2003. Now this I-129 applicaiotn with his G-325A and his Fieance G-325A and all material that was sent to TSC has been approved last Week on Oct 3rd.

          2. After finding out one week before the approval that he has listed his family business as present even though he is not getting payed since it is a family business. Now he told me that he has also given copies of all evidence that was submited to the TSC to his Fieance and he also has a copy of it all also.

          3. So he told me that he has taken the copy of the G-325A form and placed a star by the family business and at the bottom of the signature box made a star with the comment saying this is a family business.

          4. Now he told me in that he will have to send I-134 to his Fieance in India for Affadavit of support. he also has his mom sponsoring him for his Fiance. So he told me that in the I-134 he has typed in his university name. He also has three year tax returns with W2 attachments from his college in each tax return. ALso his mom is self employed and also workes. SO his mom has given her three year tax returns also. ALso in his I-134 Affadavit of Support he has placed a star witha comment to say that he is also working for a family business and named the company and since he has been working there threw present. He did nto write anything like this on his mom affadavit of support form since it is not needed.

          5. Now he also told me when he sends all this information(I-134, tax returns and phone bills etc.) to his fieance in india before the interview he told me he will also send the G-325A pack that he made a star comment on to his fieance. He told me he will have her hold on to that copy so if the Interview person at the US Embassy has a comment she can present the correction with the signature and date he has made where he has made the comment and also he told me that his fieance will explain the person who is interviewing her if questions are asked. But he told his fieance not to show the edited G-325A form if not asked by the US Embassy interview person. If they just ask what is this comment on the I-134 in pen all about she will explain it to them and tell them that he also works for a family business and he has been working there since march of 1998 to present also. If I am correct it is best to follow the US Embassy directions and answer only to questions they ask about at the interview and not talk when not asked to talk.

          P.S. So the concern my friend has is that with the G-325A commented based on the old G-325A that was sent to the TSC and now since my friend has sent the commented G-325A to his fiance and also with the I-134 Affadavit of support having a comment about his family business. Will this effect his fiance getting her visa in India? And he does have a co-sponsor which is his mom. Thanks AHalow

            Thanks for the clarification. I think how your friend is handling the situation is exactly right. I also agree with the comment that the fiancee should have the "revised" G-325A available, but not worry about submitting it unless asked to do so by the interviewer. (answers at consular interviews should be helpful and not evasive, but I agree that generally the applicant should focus on answering the questions asked and avoid "volunteering" too much; the interviewers know their job and will ask a question if they think it is relevant).

            Seeing how you explained it in your last posting, I don't think this will turn out to be a major problem for your friend's fiancee.
