    Hi Paki boy and others interested in cspa

    My sons case case is below

    1. Husband moved to US on L1 inter company transfer in 1998

    2. Sept 2000 applied for I 140-approved May 2001

    3. Within one year of visa approval in Jan 2002 applied I 485 for self and I 824 for son (follow to join)

    4. Son aged out June 2002 ref patriot act.

    5. Sons I 824 was pending at 6th Aug 2002, as was hubbys I 485

    6. I 824 got deniend Oct 2002 as became separated from file. Letter said to re-apply for I 824 once Husband got GC

    7. In April 2004 husband got green card so filed second I 824 for son

    8. The second I 824 was approved Aug 2004 and cable/tel fax sent to US consulate on sons home country on that date

    9 Jan 2005 , no news from consulate, eventually April 2005 Consulate said, never recieved approval- sent various copies of approval-

    10 Consulate then said, due to information received they will need to check if son is protected under cspa (adviosry opinion)


    No news since April 2005!!!!!!!!!!!


    Attorney says son is protected under limited exception.

    Anyone in a simular situation?

      how much time it took between your applying for your son (follow to join) and his approval. Substract that time from ur son's age and if he comes under 21, he's protected under cspa.

      If his age comes over 21, then only thing that can save him is automatic conversion to the appropriate category and retention of priority date. Otherwise he would have to wait for another unfortunate 10 years.

      You should follow the same procedure which i'm also going to follow (mentioned in my previous post). email me in case of any further queries.
