      No you're status is kind of in a limbo. You're allowed to stay while they process your application.

                Why does INS change 365 days to 775 days in the petition for ajust of status (GC) without notice the applicant?

                One year has passed, and I'm still waiting for the finger prints...and my I-94 and visa will expire on Dec.11/02...so...will I not be out of status???

                  No you won't be out of status because you have an application pending when it comes to your i94. As for your visa, was it tourist? If it's anything else that allows you to work or go to school, that's a different story.

                  Something may be delaying your application..who knows. They give you an estimate of the time it takes. Maybe they are having trouble with the background checks from your country...who knows.

                    Marie...I agree with you "who knows"...but my attorney has said that there is nothing wrong with my application ...that it is in line for processing.

                    Now she asked me to sign a document for some congressmen to inquire the INS about my case.

                    Do you think that they can help me???

                      Maybe...the problem is that ...in general...the congressmen don't know the immigration laws.

                        Before your experation date be sure to check with INS may be you need to apply for prolongation or something like this (call or walk in)

                          No...You're an "adjustee". If you filed your application before your visa/I-94 expired...you'll be ok.
