  • I-485 interview in two days....no passport

    To all those who helped me in my previous post, thank you. But now, I have another urgent matter I desperately need help with.

    Like the subject says, my interview is coming up in two days. I had applied for the renewal of my passport a week ago and my consulate told me the processing time would be 3-5 business days. 5 days have passed and they still haven't sent it.

    So my question is, will it be okay to go to the interview without my passport and just inform them that it's with the consulate at the moment and that it's being processed for renewal? Or will they automatically deny my application or will they just tell me to come back at another time to have it stamped? I have already called up the consulate but all I got was the officer's voice mail box and she hasn't gotten in touch with me yet. I plan to call them again tomorrow the moment they open.

    Whoever can help me, I will greatly appreciate it.

    For whoever might ask why I waited so long to renew it? Well, people make mistakes and I admit I made a very big mistake of procrastinating. When I called the consulate, they did tell me that it doesn't take long to process it and that was why I wasn't worried about sending it late. I should have allowed extra time in case something went wrong. /but that's the past now, I need to know what can be done to fix it.

      I am 100% sure they are going to want the passport.

      When I was dealing with my son's case, I cut it so close I had to have someone meet the FEDEX truck and drive it over to me at the district office while I waited in line.

      I managed to talk my way through the first two 'levels' of screening without it but by the time I was in the ajudicator's office they wanted the passport. I was thrying to stall them (he wasn't smiling); however, luckily it arrived literally a few minutes later.

      You really don't have much of a choice. I would still go without it and I am sure they will reschedule the interview. The other choice is to not show up and that would be a VERY (!!!) bad choice.

      I would go with what you have at the moment and see what they say. I am sure they will send you home and set up another date.

        Just an interesting side note:

        I was also able to talk a Canadian Federal civil servant to come into work on a Saturday to finish my Passport request (they had lost it somwhere in Ottawa) and she FEDEXED it out to me for a Monday AM delivery. I had it in my hand by 11:00 or so...

        Wouldn't it be nice if there were more civil servants like that around...

          You must attend the interview, with or without your passport. Your passport has nothing to do with your AOS or any other immigration benefits. Instead, a passport is usually asked just to be stamped your immigration benefits like your legal status, that is. If you don't have passport at the time of interivew, then you can always go to your local BCIS office to get stamped about your legal status anytime once your case is approved. It usually takes only 5-10 minutes only to get stamped. Nobody will take your interview again. If your application is approved, then your status would be in the system, which can be seen/verified by any BCIS agents worldwide, like the officers at port of entry or at any BCIS offices. So, you don't need to worry about your passport. Anyhow, officer will ask for it AFTER your case is approved so that s/he can affix a stamp on your passport as a evidence of your status until you receive your actual plastic card in the mail, And if you won't have your passport, then just show them the receipt or any other paper work or correspondence which would show that your passport is under renewal. Officer would only say to you that you can come to local office anytime to get your passport stamped. That is it.

              I just wanted to comment on "it should only take 5-10 minutes to just get teh passport stamped". That might be true at a large district office. However many of us live several hours from even the closest aplication support center, where one would have to stand in the general information line for about four hours because there is no separation of different activities. ie- passport stamp waits in the same line as all status requests and other actions.

                Hello everyone!

                Thanks again for all your advise and good words. Fortunately, my passport arrived 12noon the day before my interview. And needless to say, the interview was quick and painless. 10 minutes later, I got my passport stamped (even tho we weren't able to produce my husbands income tax papers for 2001). I think it was the fact that we already had a baby who is now 15 months old that proved our marriage to be legit enough. The anticipation and panic is now gone. We can travel easily now to visit my familly and back. With both the form I-512 and the stamp on my passport, I do hope I still don't get dellayed by customs!

                    Congratulations!

                    I have crossed the border literally dozens (and dozens) of times with no issues (knock wood). I guess it depends where you are going and coming from and the luck of the draw...

                    Just as an FYI, I travel into Canada onto my Canadian Passport, and then return into the US using my GC...
