  • Can I file for my mother

I recently became a US citizen and will like to know if I can file for my mother who came to the US with a visa and her visa has expired.

Yes, you can file for your mother.

However, given that your mom is an illegal alien, she will be unable to remain in America for processing.

I guess that overstaying her visa seemed like a good idea at the time...right?

Here's yet ANOTHER proof of these "citizens" who went thru the process ONLY to bring their families. Only don't forget to take your mother and rest of your family STRAIGHT to social security so she can get her SSI checks without delay. Also, she will get her Medicare, food stamps, freee Rx, etc. But you know all this already.

Yes, you can file for your mother and she does not have to leave. You should file the I-130 together with the I-485 and I-765.
