  • I-485 filed prematurely! what next?

    Here's the case: the son of an LPR filed a Section 245(i) I-485 application. The problem is that there's no immediately available visa number yet.

    The Petitioner, his mom, will be a USC very soon, which will upgrade the petition to 1st preference and the Priority date may become current within a year.

    What would happen now? Would the BCIS reject the application or deny it? Or before it even gets looked at, the visa number may become available?

      You must wait till your Visa becomes current. There is no other way out. When your Mom will become Citizen your Priority date under F1 will be adjusted to that date only.
