I don't think you have to. You should apply for AOS based on your DV Lottery asap. If INS will ask you for waiver then you can file it.

You can apply for a waiver? I thought those in violation of immigration status are automatically excluded and void should they "win" the DV lottery?

yes you are right Charles...I think you will need a waiver..you cannot just go and file for AOS as suggested above...
