      IT DEPENDS HOW HE ENTERS THE COUNTRY..

      iF HE CAME HERE ILLEGALLY THEN HE SHALL NEED A WAIVER...
      IF HE CAME HERE WITH A VISA AND THE RIGHT DOCUMENT..THEN IT'S EASY I GUESS TO GO TO THE INS GET A FILE AND FILE FOR HIS aos.

          Waiver, i-601 is for misrepresentation such as fraud. Usually the person passed the Inspections.
          If your husband came here without inspection, this waiver may not be for him. The 245i may be the relief for him.

            I think he needs a waiver for hardship..it's a hard one...I filed it 3 times and got denied...i did it with the help of lawyers..and i am hiring a new lawyer right now to file one more time...
            there is a long post on this board by mohan regarding thtis waiver ..it will help you if you look at it..there are also some people on this board who posted regarding this waiver..
            I think you can do it by yrself too if you think
            you are able to gather all the necessary papers and elaborate the necessary statement...

              oh ok distance...sorry i thought that the waiver i-601 applied to all kind of marriage problem...
              anyway, that waiver i-601 is alomost impossible
              to get it approved by ins...so you are not loosing anything here..

                  the filing for 245i ends April 1, 2001. Check some other info if this was extended again. Also the date of marriage is important, I believe on or before Dec 2000.
