Marriage to a US Citizen entitles someone to apply for naturalization 3 years after they were granted residency provided they are still married to that citizen and meet the other requirements.

It's 5 years of residency for everyone else.

It would not be considered fraud, especially not when the spouse waited 2 years longer than they needed to.

If alien files for citizenship based on marriage to usc, then the application is in jeopardy of being denied if found out. Not deported..

If the alien filed citing 5 years residency, then there is on problem filing for divorce during this process because it is not based on the marriage to usc.

If the alien has been a PR for 5 years, then divorce would not impact their Naturalization.

Just file it on the 5yr LPR basis instead on the 3yr marriage basis. It has nothing to do with the marriage then.

Legally, I believe this is done everyday but if I had my way, the perpetrator of a Green Card Marriage for the purpose of using the US Citizen to gain US Residence should be publicly flogged and deported with only the possessions they came here with. Moreover, now that the United States of America has been destroyed, along with its quality of life, only a fool would decide to come here. As for me, I am upgrading a 65' Motor-Sailer and leaving this rats nest...you are all welcome to what was my home and the home of my family since we came here in 1607.
