    Is there any kind of unemployment insurance for H1-B? I have heard different opinions, so what is the real situation? We live in NJ. Thank you.

      My understanding is that H-1B workers are not eligible for unemployment, due to the fact that they H-1B visa holder is not able to accept employment if offered. The H-1B holder must be sponsored by an employer before he's authorized to work.

      Generally, for workers to be eligible for unemployment, the worker must be actively looking for work, and able to accept employment. There are additional requirements of having enough qualifying employment prior to the period of unemployment, but these vary by state and would affect an H-1B worker the same as any other potential applicant.

        How about employees with a TN status? Are they eligible to receive employment insurance? And do they have to go back to Canada if they receive UI?
