    Hi fellows.

    Thanks for helping people. Keep up the good work. I have a question for a friend, who was in usa with visit visa in 95, He won DV lottery with a name and date of birth other than his real name and date of birth. Then he applied for AOS inside US, got EAD card but in final interview he was refused AOS. he got a letter from INS to leave the country and he did left USA in 96.

    Now can he get his H1 visa under his real name?? any suggestion would be very helpful.

      It will really be difficult for him to get any immigration benefit in the United States, as he had commited fraud already.
      It will be best for him to forget about the United States and try in some other country.

        Umesh you are wrong..!!! He can go for his H1 visa, because his AOS application was based on other name and dob.they can't find anything under his real name.

        ** He can even ask for Waiver**

          Well Umesh might be right coz what happened if he already do the FP? Do you think they don't get his real identity after that? Normally FP done before interview right? So....he might be safe if they don't check it when he done his other FP when he come here...but what happened if they can trace it. Thats painful. Well, anyone have to take the responsibility for their act.
