    Hello,

    My wife for 12 years has been a US citizen for the last 3 1/2 years. 5 years ago I came here illegally using a different name. When my wife became a US citizen she filed the petitioned for me through an immigration lawyer. When the lawyer filed the petition he did not avail the LIFE Act signed by Pres Clinton. And now, my lawyer is telling me that there is nothing he can do about the situation, and he is advising me to go home and wait for my petition back home in the Philippines. If anybody knows a workaround about my situation..please reply to this post. Thank you.

      It is expected that 245(i) will soon be extended as the President and both parties are eager to extend it. When it will be extended then you need not go to your country and will be able to adjust your status here in the United States. Just wait for it and pray.

        u should contact some other lawyers and ask for more advice. When did u file your petition?
        From what I know, there's still hope for you If u are married to a U.S citizen even If you're already out of status.

          Let me spread some light to you. you have to take see wait and see aproach there is one public Law introduced recently In federal system WAis( i will try to post the link.)
          As I don't know your whole case story I cannot predict. here is the link , IF it goes thru You may be entittled to get immigration benifited.

            I think you still have an opportunity, to avail the Life Act under 245 (i), you'll have to pay a $1000 penalty and you hve to show proof that you were in the country in December 2000. I strongly suggest you consult another lawyer.

              Mohan, I just read that link. Is that actually a law? It seemed like it was just a request from Utah for the congress to work on resolving those issues. What does it mean? I am USC married to illegal Mexican (he snuck across the border). He has been in the US for five years and married to me for 1 1/2. Will this be good news for us?

                    Almost same situation here but already filed waiver 601 (denied) and filed 601 waiver appeal (result not in). All with lawyers assistance. Knowledgeable posters please comment/advice. Thanks.

                      that was pvt bill which was introduced. no new update yet.
                      to citizen;
                      write your case history and what was the cause of waiver and how you prove extremely unusual hardship to USC. will tell ya.
