    I already posted this message once but noboby gave me an insight..Could you PLEASE help me here??

    <Does anyone one know about a new law making a second background check on every adjustment of status(not with the FBI this time) applicant mandatory???.Our application has been stalled for almost a year since the interview because according to our congressman,the INS is only waiting for the results of from my wife home country to adjucate the case.We thought that the only one needed was the one done through the FBI after the fingerprinting!!!Any insight on that??? >

      Not that I know off. Ins may have already send the Background check to the respected country but they might not hear back. some countries takes longer to answer for these enquiries, and some time never replies. this problem is not within the INS but to the countries of the applicant, INS has to update the record based on the input , and if input is missing then application goes to a halt for indifinate period.

        Thanx for answering man!I appreciate that.Another question though:in case the home country takes forever to reply,isn't there a way to have the INS adjucate the case by default??After all,the fact that the country did not answermight be due to them having lost the demand or something else?!It happens a lot in 3 word countries!In that case,there is no way to know how long it will take for them to answer if ever..Do we have any legal options??
        Also by the way what agency does this background check anyway??If we knew where the hold was maybe we could call the agency directly and have them take care of it!

          Mostly criminal record, any pending case related to justice or law where the applicant is bared to leave the country etc etc.
