  • Divorce and a permanent green card

A polish immigrant that has a temporary green card (approved I-485) based on marriage gets divorced after eighteen months of marriage. How can she get a permanent green card without her husband's signature?

Note: She was not beaten and cannot file a battered immigrant petition.

The purpose of the conditional card is to establish the validity of the marriage. Divorce does not automatically render your status no good, if you can show that the marriage was valid despite the divorce.
