  • H1B Delay

I am presently on a TN visa that expires on Sept 21. However, my employer applied to have me moved to an H1B on May 31. Due to delays with INS they are drastically behind and my H1B will not be processed most likely until the middle of Oct. Due to the limited amount of time left on my TN I was told I could not get an extension in time on it. I was also told that I would therefore have to cross the border and renew my TN. Does this cancel my H1B application? I thought I read that if I left the country the H1B would be cancelled. The problem is compounded, as my wife is to undergo surgery on Sept 24. So no matter what I need to be in Canada by then, H1B or not. Any information on how I should proceed would be greatly appreciated
