  • Foreign Nurse, out of status, visa waiver overstay

People from ILW, I have a friend who is a nurse, entered the US on Visa Waiver Program and has overstayed therefore is now out of status, is there any way that he could get a job in the US as nurse and get sponsorhip for green card?

Yes. True love will solve his dilemma. He can marry a US citizen and file for adjustment. Another option in other, similar scenarios would be asylum, but since he is from a visa waiver country... No. All other options are cut off for him. He can stay here illegally, working under the table and hiding from BICE until he gets hitched, or he can go home. If he goes home, he probably won't be coming back since he violated the terms of his visa.

visa waiver holders are specifically barred from adjusting their status on any kind of status. That is the whole idea; citizens of countrys with none or few visa violators, trustworthy enough receive this visa type. The more people from his country violate their terms, the sooner the visa waiver program - especially for that specific country - will be eliminated.

          Technical correction

"visa waiver holders are specifically barred from [CHANGING] their status"

They can still ADJUST in certain circumstances, such as an immediate relative petition, but they can not change or extend nonimmigrant status under the waiver provisions.
