Guest repliedEven if your occupation is under schedule A category it's impossible to adjust your status because you came illegally.If married to USC, you are "seeing a light at the end of a tunnel" here.There is a waiver for this fraud but it's very hard to get approved unless you convince the INS of your spouse's extreme hardship.You need a lawyer for this complicated case.You will be able to work while your AOS is pending, let us know your whole situation because I'm just giving you some scenarios to take.

Guest repliedIf you have been in the United States for less than 180 days without a valid immigration status, there may be some hope for you. Possibilities include H-1C or AOS with a waiver.

Guest repliedillegal is different from out of status. if you are illegal i think it would be hard. you have to consult a very good lawyer. they are expensve thought especially since you have a special case. did you file before the 245(i) deadline?

Guest repliedThank you for your response Brown Fox. At one time there were many more professions on the DOL Schedule A. Therefore I am trying to find how to go about viewing it on the DOL website.
