    Me and my Girlfriend are currently overstayed on a VWP by about a year and a half. We have a five month old baby girl who has her ss number etc.....

    Is her status unaffected.....and does it change our in any way?

      Your child, although being an USC cannot sponsor you until she turns 21.

        You and your wife has been overstayed visa and you has a child. Your child is 100% u.s. citizen coz she was born in the u.s. She is unaffected no matter what her parents are overstayed so when she turned to 21 she will be sponsor you. She'll still be able to get anythings in the u.s. My question is how did you suvive yourself in the u.s as overstayed?. But although you both overstayed you will still be able to get anythings for your u.s. citizen child like food stamps.
