K-1 married to married man?

  • K-1 married to married man?

    I came as K-1..Now I married to guy, and his US divorce didn't approve in country where his first wife lives and first marriage took place.
    Is my marriage valid? Is it BIGAMY?..and what i have to do, if he didn't want to finalise divorce?

      Whether you have a valid marriage and are committing an act of bigamy depends on the law of the state where you are living.

      An argument can be made that the marraige is valid, because neither of you knew of the failure of the divorce.

      If your spouse has been resident in the State for awhile, it may be possible for the state court to take jurisdiction and grant the divorce.

        Thank you for reply.
        just thing is..now he found some pluses and do not want finalaze divorce. He regularry go to this "other " country to visit his "first" family and spend time with them. When i am talking that i don't like it, he is telling that if i do not like it, then he will divorce me, and remove AOS application for me and my kid. Now is 1,6 year after our wedding. Any idea what i may do my situation?

          Yes, it is all i really want to do sometimes.
          He is being unpleasant, even rude to me and to my kid. But i am in USA for 5 years ( 3 years i worked) And kid also adopted to country for last 2 years. Nothing( no job, no place to live) and
          nobody( i have no family ) i can go back to in my homecountry.
          It is why i am in on this site.
          Askind what options i may have. If my afford to make this family works will have NO success.

            you can called a domestic abuse hotline to see what to do..

            Emotional abuse and neglect are forms of abuse and they can help you.

              Which State do you live in?
              Is this man father of your son?

              I believe you should - first - seek advice from a social assistant, or a priest or any other spiritual leader you may know. He/she will give you important emotional support and professional viewpoint. Listen to his/her orientation.

                Thank you for information.
                I live in NYC.
                My son is 13 years old, he came with me
                in summer 2001 as K-2,
                My USC husbend has double citizenship and in other country of his sitizenship he keeps his first marriage valid and has 2 kids there.
                He is not my son's father.

                  When you got married and what is your legal status here. It seems that you did not get Green Card yet. If your husband has sponsored you as a spouse then you can get help from SAKHI, a non-profit organization. SAKHI telephone number is (212)714-9153 and ask for Ms. Sabeena. Sakhi is located in Manhattan. SAKHI will help you in Immigration and other legal matters. May be you are eligible for Green Card as a Battered Women.

                    Also, looking at some information that ai have,

                    You can call South Brooklyn Legal Services, 718-237-5500. You may be about to file for spousal suuport if you hasband is not taking care of you and your child financially. You can go to bklyn Family court at 283 Adams ST Rm 157.

                    There are also Family courts in Manhattan, downtown near City Hall, Queens: in Jamaica, E or F train.

                    Try calling this service. They can give you a better idea of what to do. Also try out Umesi contact as well. When you have a specific name to get a hold to, that helps as well.

                      I came with my son as K-1, K-2 June 2001
                      We got Married in August 2001.
                      September 2001 He filed AOS application for us.

                      We got reciept in 2 weeks, and nothing else
                      till now, but i know in NYC waiting time is
                      about 2 years. Also i got EAD about year ago.

                      But everything changed for as as for marriage.
                      His first still valid family he visit often,
                      His treating of me and son,
                      I work in his own company, but he tells it is just for leaving in the house. And sure he tells me that he will trow away me from the house,
                      withdraw AOS application, and file divorce every time while i am not "happy" or have any needs.
                      Because he has no friends, and no people he keeps in touch with I have no witnesses then.
                      His customers know me just as his secretary.

                          Once your husband has filed for AOS for you, you will be eligible as a Battered Woman to get your Green Card. As I had suggested you in my previous reply, contact SAKHI, they have their own Attorney who will represent you for free in Matrimonial and Immigration cases.
