  • AOS pending ---

    I heard that if there is a AOS case pending then probably nothing bad happen when some one will go for registration. My labor certification[ under life ] is pending almost 13th months. Is this is a AOS case pending or If i got my EAD by now and then i applied for my green card aplication with fingerprint/medical exam and panalty and got a recipt from INS/BCIS [whatever the name is] --then that will be a AOS case pending ? I'm confuse which one is call AOS case pending ,can anyone please clear this for me ?Thanks in advance.

      AOS pending means your application for Permanent Residency is pending. If you have applied for AOS with BCIS then you need not worry about this registration, you just go there with all your papers and letters received from Immigration. Everything will be okay.

        AOS pending usually refers when you have submitted form I-485(Adjustment of Status) to adjust your status to become LPR. To make it short, at your present status, I don't think you're technically qualify for "AOS pending".

        I'm not very familiar with Life related application though. In the regular Employment based AOS, once your receive your labor certification, you'll need to proceed with submitting your I-140 & I-485 application (usually also accompany by your EAD application). Once this is submitted, you'll fall to the AOS pending status. Even then, some might say that you're not in that category until you receive your A#.
        Perhaps someone else can help clarify this?

          A quick question though, at guest's present status right, is he/she aos pending or not? Note that the permanent resident application hasn't been submitted at this point.

            Thank you very much both of you . I'm afraid You are right guestuser . May be Mine is not AOS case pending. because i have not get my EAD yet. but Mr.Passi ,i want to be sure .My case pending with labor dept. not with BCIS , I applied under life [employment bassed ] .but before i adjustment my status i have to have my EAD .So where i am right now.AOS case pending or not ? Sorry about this. Its not clear to me yat. I only has a recipt from labor dept that they recived my application which is procecing thats all.I'll be apriciated if you clear this to me again. Thanks a lot.

              To guest:

              It seems that you have no idea whether your attorney has filed AOS application with Immigration Department. Usually, both applications are filed together and Immigration application is subject to approval by the Labor Department. This is done to get earlier priority date with the Immigration.
              It would be better to check with your Attorney, to check whether your application has been filed with the Immigration or not.

                Yes, you are right .I have no idea about law.and my attorey was mad at me when i asked him couple times --want to clear about this .He said he knows what he is doing. He said after i recive my EAD then i' ve to file my green card aplication .I already visited him twice last months. and he said i've nothing to worry about .i can go for registration with those aplication i filed and that recipt .it will be ok. so i'm praying now .hope everything will be ok.thinking to go April 2nd week. thank you so much for your help .

                  Your attorney just wants BCIS to put you into removal proceedings when he says you to go for registration. That way he'll make a lot more money from you when representing you before the Immigration Court.

                    W-E-L-L--- now this is too scary now.but don't know what to do without him. so i'm trying to keep faith on him and god. let see what happen. Thanks for your reply.
