  • Inadmissible........Illegal Entry.

    When some one's FOIA says he/she "Entered USA without being admitted or paroled by Immigration Officer" and is charged for violation under section I6A1.

    He/she is Inadmissible for how long? Is there any non-immigrant waiver available?

        I'm not sure how long you would be inadmissable for, but first you would have to leave to try to get back in. And if you have been here illegally for 180-364 days, you will be barred from returning for three years. If you have been here illegally for 365 days or more, you will be barred for ten years. You may not adjust your status by getting married, etc. There is a waiver for this (I-601), which is virtually impossible to get. No one gets it.

          There are other things that might also affect the length of time of the bar that is given, which could be anything from your own actions, to the interaction you have with the ins officer that assigns you the case, to their mood.

          I don't think that is actually law, but for example, my husband was in the USA for over 365 days illegally, left the country and attempted a legal re-entry. He was given a five year bar.

          And from what I understand the administration of these bars is somewhat under the discretin of the attending INS officer's.... but if you get one it will be (at best) 3 years and (at worst) 10
