    I am a US citizen and my boyfriend lives in Mexico, we have been exploring the options for him to come to the United States. He applied for a Visitor/Tourist Visa in November and was denied. I have a close friend who owns a construction company and would be willing to sponsor him for some type of employment visa however I don't have the slightest idea how to start that process or if it is even possible. I would really appreciate any information that anyone has about that. I would also be interested in any other suggestions could help us. Thanks! Becky

      You said your are a USC. It will be better for you to go to Mexico and get married there. Then file sponsorship papers at the U.S. Embassy in Mexico. It will be very fast, say in a couple of months your husband (now boyfriend) will be here and you don't have to worry about anything. When he will reach the United States, he will be a Legal Resident Alien (Green Card Holder).
      If you will apply for him as a Fiance, it will take atleast 4 - 6 months. Then when he will reach here, you will have to marry within 90 days and then file sponsorship for him. Which will take several months, may be more than a year for him to Conditional Green Card for two years.
      If you really love him and want to marry him. Go to Mexico, get married and sponsor him there.

        I am actually more interested in having him come here BEFORE we get married. I would like to spend some time with him here to see if a future marriage between us is what we both want. So far all the time we have spent together has been in Mexico and he doesn't know anything about my regular life in the states. I would like to look into alternatives to him coming here besides marriage (unless we determine that marriage is our only option) Does anyone know anything about the possibility of him being sponsored for employment by a US employer? Otherwise what is the likelihood of him being approved for a visitor/tourist visa if he applies again? Thanks! Becky

          The odds of a tourist visa are virtually nil - why? Because the embassy has to believe that your BF would return to Mexico after a short visit instead of running off and getting married.
          Since Congress has made a fiancee visa, that will likely be the one the embassy tells him to get.
          It won't do you any good to "promise" that he'll return - the consuls know far too well about these unfufilled promises.
          AS far as employment visas, the US company has to advertise for American workers and only if none apply (that are qualified) could your BF be in a position to obtain that kind of visa. It is not impossible and may depend on his skills in construction. BUt of course you can imagine that there are many many American construction workers out there wanting to work. Anyway, it's a chance probably worth taking.

            My boyfriend is a homeowner, he has a steady job, he has plenty of money in his bank account and we thought there was enough "proof" that he would go back to Mexico after a visit, the consulate thought otherwise. My hope with the employment angle was that if my friend only offerred to pay minimum wage for a construction position, very few workers, even if unemployed, would be willing to do the job. However, my boyfriend would be willing to do it for minimum wage. I am interested to know what my friend would have to do (after advertising the open position) to begin the process of applying for my boyfriend to come to the US to work for him. Any help would be appreciated! Thanks...Becky

              Part of the process of labor certification for an immigrant visa is the job, its duties, its pay must be fairly consistent with a particular industry. To have the job be offered at a low wage just to attract your BF and exclude American workers won't work.

              As far as your BF's house, bank acct, etc, well, the sad truth is that those folks with a US BF or GF readily abandon all of those things to marry and get a green card.
              Already you seemed to imply that your BF could drop whatever he is doing (which is unclear what that is) and go work for minimum wage in construction. This appears to undermine the reasons he might have offered as to why he would return to Mexico after a visit.
              More than likely the consul got wind of your relationship and not much is going to convince them otherwise - and there is little evidence that they would be wrong overall.
              While the fiancee visa would take longer to process, once issued it allows a 90 day visit and you must marry or he must leave or face severe penalties. The same is not true if he entered on a tourist visa and once again the consuls know this.
              Money in a bank account is really not a reason to return to a country - after all, how long does a withdrawal take? Someone getting a visitor's visa could run down to the bank 10 minutes after getting the visa, empty the account and disappear!
              Other than marriage (or the fiancee visa) there is little likelihood your BF getting a visitor's visa or the immgrant visa if the job offer was bogus to begin with (insofar as undercutting the prevailing wage for a particular job).
