    I entered illegally into the us, then i got married to us citizen.INS arrested me and deported me can i get k3 or an immigrant visa .I really need help. I cannot afford a lawyer.thanks

      Hi Nadeem,
      If you would not mind can you please post more information about your case. But based on the information you have given so far I think you have slim chances becuase you were deported by the INS. if you had left the country illegally with out getting in trouble then you have high chances. This is my input. If I am wrong I do apologize. If anyone else can give better input then me please do so

        the limited info you provided based on that you are not eligible to get k3, relief is available to you in form of relief if you can prove hardship.
        Its a discussion, not a legal advise..

          You gotta remember MILLIONS of people are asking to get into the US every year. The INS ain't gonna shed a tear that those who break laws, are put at the bottom of the list.

            you will be subject to a bar for entering without inspection. if you file K3 you will have to possibly file a 601 waiver showing extreme hardship which doesnt necessarily mean being apart from your spouse.

              See the thread regarding I-601 waivers that was started by Spouse. There is a lot of good info in it if that is what you have to do.

                Thankyou all for your advices.V patel asked me for more information.Actually i was a crewman on board the ship.Upon arrival of my vessel at Houston the Ins issued me a landing permit of 29 days and this landing permit says that i have TO depart on the same vessel on which i have arrived.This landing permit also called [I-95]or [D-1 nonimmigrant status] so this means that INS inspected me.But according to the law i did not went back to the ship but stayed in the US and so broke the law.I didnot entered copmpletly into the US ILLEGALLY because i was inspected by the INS.After two years i got married to permanent resident, my wife now is US citizen.We filed i-130 petition and after two months after filing i-130 i went for special registration which is called NASEERS BECAUSE I HAD TO BE REGISTERD.INS arrested me and deported me expeditly.I donot have any criminal record.Nowadays i am very depressed can i get k3 visa or an immigrant visa.

                  You shouldn't have gone to the NSEERS Registration. Even i could've told you it would've been discontinued. Now you got deported. You should've continued the marraige application.

                    I went for the registration NASEERS because i wanted myself to be on the legal way, so now what i do.Can i get k3 visa and how long it will take to get the visa .Please i need advice from you guys.My great concern is that if i donot get the visa i will be in deep trouble.Finacialy i do not have a job here and i love my wife .she cannot come here because she is studying in the US.I am depressed man on this earth . i need advice from you people

                      dude, you got deported. you need a waiver now. Good luck on getting that.

                      You were stupid. You should know that most illegals are smart and know that if they stay long enough -- they'll get gc's. I bet when you read Bush's proposal, you felt like an idiot.

                      NSEERS is for people who are in valid status, to register. If you're illegal -- you shouldn't be surprised the country kicked you out when yo uvolunteered yourself at their front door.

                      Deportation means the country doesn't want you. You can't just waltz right back in.

                        You're forgetting something moondin, not registering during NSEERS is a ground for deportation by itself. What do you think will happen when USCIS processed his I-485,etc and found out his name is not in the NSEERS list?

                        As for the original question, as many had answered, you'll need a waiver first before you can apply for the K visa. Look into the I-601 for the waiver requirements. I don't know whether coming from a special registration country will make it harder or not, although the odds doesn't look to be on your favor right now.

                          I'm not sure how it is looked at when someone is actually deported but as far as the overstay goes, trying to get back in the U.S. with a K-3 is about the best way to do it according to several attorneys that I've consulted with. Hopefully Mohan or Sammy or one of the other experts will reply in response to your question.Have you actually filed any paperwork?

                            I went for the NASEERS registration because my lawyer told me to do that.Forget the past please.past is passed.The question is now what i do .Can i have highier chances to get the k3 visa.Can i get an immigrant visa and how long the process will take.Do i really need i601.Please Mohan, Sammy i need your advices.THANKS

                              even if you got in -- your previous deportation will pop up. And then you'll be back ont he deportation plane once again.

                              Bush's proposal forgives illegals for past visa/law violations. Including NSEERS.
