  • LC to I-140. One year passed? Move ahead...

    I just heard from my attorney that if 1 year has passed since we applied for the LC, and no response was given yet, then we are entitled to apply for the I-140... what would then allow for a 1 year extension after the h1-b 6 years limit.

    True or false?

      the rule is, if 365 days have passed and there is still no word from DOL regarding you LC, you can then go beyond the 6 year limit for you H1-b visa, in one year increments for extension
