Hi guys...I hope someone can light me up with hopes...but, we applied for 245i, back in Feb 2001, we gave all paperworks and money to the attorney to file our process with Labor Dept.
He shelved our case and did not walk the papers in to file by april 30th, instead, he sent over registered mail and kept receipt of april 30th 2001, eventually, our priority date on Labor Letter was may 2nd 2001,two days later deadline, time passed, company A closed, and company B took over sponsorship in 2003, we file with USCIS in 2007, got EADS and in Feb 25, received "intent to deny letter" asking evidences that we filed on or before april 30th, we sent the LAbor ETA letter with date of may 2nd and the copy of the receipt of registered mail, We were denied in march 25 saying we were not elegible for 245i since our letter shows date of may 2nd, we are brokenhearted as we found out we were scammed by this attorney in massachussets.
THis new atorney said she will file MTR to avoid removal letter and said we have good chance to win the case because back then, the law was gonna be extended (which never happened thanks to 9/11).
Do I have any chance? should I prepare for the worse? how long does it take for MTR to have an response?
Please, Help me if you have any evidences from back then that might help as i know I need a miracle
