What happens if a person without a status, who entered the US legally, but overstayed his visa, (an illegal immigrant) marries a US citizen?

The person would be able to change status and the overstay will be forgiven. Got to do a lot of paperwork, but everything will be fine. Good luck.

You file these forms ASAP. Look under "Family Based Applications" -Immediate Relative.

You will be forgiven for overstaying by BCIS as long as it is a legitimate marriage, and not a "sham" to obtain a green card.
