And to the guy who said that since you are married to USC you can adjust yr satut no matter what. well that not always true. if you came here illegally without inspection than it's impossible to adjust you need to wait for the 245 to come back again...

Let me know what was filed. I guess you should check your attorney's competency.First of all your waiver should be based on before IRRIRA of 1996.
which is under IMMACT90. waiver is eaiser to prove under IMMIACT90 then IRRIRA of 96.
Second, this waiver can be for both Alien AS well as USC hardship.
third, Then standard of Hardship is nominal. If you your waiver is not apporved then there should be some missing part OR not written correctly.
Of course, Waiver is hard to approve , many times it was either not required/asked or not reps in professional manner.( yes .Lawyers do makes mistakes and don't admits, or sometimes they only limit their servise to get clients money, thats why you need to get good lawyer)
Answer to your psychitric Situation, Alien can prove the psychological trauma and emotional stress due to seperation from the family. Certificate helpful( required if no other solid points but not necessary.

WAIVER CAN ONLY APPLY FOR EXTREME HARDSHIP TO USC, HARDSHIP LEVEL IS INCREASED TO UNUSUAL EXTREMELY HARDSHIP.

My Lawyer filed a 601 hardship waiver for me
last year in April,I have my work permit but
no interview yet,so I am waiting for my
interview appointment.My Lawyer calle't me
last week to tell me that now I need to add
more information to the 601 waiver application
and he would have to go with me to the interview,
and yes he needs more money,but I have paid him

don't give up hope entirely; try to involve the governeour or one of the two senators. If they can in-put something on his behave, the BCIS there will certainly take that into consideration.
Being here for 8 yrs. and not having any other problems with the law, if he can establish that he's a good person (with the exception of that misrepresantation) he may be able to get discreationary relief. Good luck!
