Do we really need a lawyer?

There are some facts here that don't rhyme. You said your fiance is illegal but applied for citizenship 2 years ago.How could he applied if he is illegal? Is there a sponsor, was there an approved I-130, AOS? Are you a USC? We can't help you if you won't be specific with your situation.

you may very well need an attorney. But we definitely need some more information. How long has she been out of status? was the no in school a now in school or a not in school?

Having a social security is not enought o be working legally int he country you have to have proper authorization as well, although paying taxes under a tin (tax Id number may prove to be useful)

If your fiance has overstayed by more than 180 days than it is a different and more difficult scenario than if she hasn't.

If she hasn't you may want to consider a brief consultation with a lawyer to see whether she could leave the country and apply for a fiance visa or something of this nature - of course if she has overstayed by more than 180 days she is already subject to a bar and as a married couple you will need to file a waiver - which as you may have heard from some of us, is quite difficult and very frustrating!

We would like to get married in March and of course would like to become a permanent resident as well as a citezen.
