    Hi,
    My US visitor visa was cancelled 7 years ago under the 212 (a)(6)(e) section of INS. I pursued a court case against the Mumbai Consulate to protest my cancellation and won.

    Now my question is if I try to apply for a visitor visa will they even entertain my application ? Should I instead try for a 'waiver' ?

    Hope this is the correct thread to post this type of message.

      Why it was cancelled at first time and what is basis to apply this time? What and why did you take the matter to court and what did you win out of this court fight? Is there any bar mentioned to you when your visa was cancelled first time? Please elabroate.

        I had received my 5-year US Visitor visa in 1994. In 1995 I adopted a girl from a family friend. The same year I tried to get a visitor visa for her. Before that I changed her legal name to be under my family ( new passport).

        However it seems my friend had also tried to get a visitor visa for his family 2 years ago and was denied. So when I went to the Visa they told me that the girl already had a old passport under which she was denied. They told me it was a forged passport and submitted my case to the local police in Bombay, India.
        They also revoked my visa under the section mentioned earlier.
        I was charged with forging a passport and a case was lodged against me. I fought the case and won with all charges against me being dropped.
        Essentially according to the Indian Legal system I had not done any wrongdoing by getting another passport for my adopted daughter.

        There was no bar mentioned to me when the visa was rejected. So my question is now if I try to get a J-1 visa with all supporting documents will they still deny it based on old refusal ?
        If they still deny it can I go for the 'waiver' ?
