i601 Denied... AAO vs Immigration Court

  • i601 Denied... AAO vs Immigration Court

    My i601 just got denied. I filed i601 along with my i485 for my adjustment of status here in the U.S last year, i130 has been approved but my i601 for a conviction of receiving stolen goods in 2002 was just denied.

    I am trying to decide if I should appeal it to the AAO or go before a judge. The AAO process takes an estimated 18 months and that is so long because time is so important to me and my USC wife. My lawyer prefers to go to court and frankly I do too.

    Also, I have not been put into proceedings yet, how can I fasten that process if I decide that I want to go before a judge?

    Please advise.

      The thing is that you cannot put yourself in proceedings. So, while you are waiting to go into proceedings you can appeal to AAO.

          I was informed by my lawyer that I will not be put into proceeding if I appeal to the AAO. and that has happened before I have had my i485 denied bcos I did not file an i601 and I was not put into proceeding.

          That is why I want to make sure I get put into proceedings so I can renew my EAD before it expires.

            If you appeal you will not be placed into proceedings if your appeal is timely. However, you will be denied, 99% chance. So it sounds like you are just trying to extend your EAD. Otherwise, in the end, you will be in proceedings.

              Actually I understand that an appeal will be likely unsuccessful, that is why I want to be put into proceedngs so I can go before a judge, where I feel I have a better chance.

              I just want to make sure I can get a new EAD before my current one expires. I intend to get that when I apply for AOS thru the court.
