    Mohan, I want to ask you a question, as you are probably the most knowledgeable person on this board.
    I asked it once before, but would like to get your opinion.

    I have a friend, who came to the US on B1 visa and them married USC. His visa was not expired, he was not out of status.

    They have not had their AOS interview yet.
    His relationship with her deteriorated recently and it is unclear if she will go to the interview with him.

    My question is: how viable is the option of divorce and second marriage ?
    He does have documents to prove that the first marriage was a bona fide on: joint lease, accounts, wedding photos with her family members present. She even had an abortion. However, his attorney claims that obtaining abortion records may be difficult. He can also submit affidevits from several people re their marriage.

    I am basically trying to set him up with my friends and I think I have found a good match.

      second marriage is viable and he can get his status adjusted thru second marriage, he will not have any problem.
      Make sure that first marriage should not took place within 90 days of his arrival.

              This is legal (just make sure to follow all state laws regarding divorce and marriage for his residence), but the situation raises red flags. Your friend should be prepared for delays in his case since it will likely be scrutinized for marriage fraud.
