Sir Chartres Biron, ruled that authors could not testify as literary merit was irrelevant. On 16 November 1928, he found the novel to be obscene on the basis that it had the ability to corrupt, ordering its immediate removal from circulation. An appeal the following month similarly failed, with judge Sir Robert Wallace labelling The Well as "more subtle, demoralising, corrosive, corruptive, than anything that was ever written".
