  • SAMMY: offense and its effect on 751/N400/Travel

    Sammy and all other reader,

    Let me explain you my case:

    I have filled for I 751 in april 2003. In month of June2003, I committed an offense
    "patronizing Prostitute" and I had a lawyer for that and I got Diversion in that case till august 2004.
    It is not a conviction and I have to be out of trouble till august2004 and taken one class as suggested by court diversion agreement. After completing the diversion in august 2004 , the complaint will be dismissed.
    My wife know about all this and she has decide to forgive me for my mistake and we are living happily right now.

    Question:
    1. Since I am on diversion , I heard that if I travel and when I return back my record will show an arrest on the airport for this offense and they will put me into removal proceding or they won't allow me to come back in USA. Let me know your ideas/thoughts on this one.

    2. When I completed my diversion in august 2004, the court will give me the disposition letter that will show that charges/complaint has been dismissed, After that can I travel and comeback without having problem at the airport if I carry those court disposition letter and my case will be dismissed at that time? let me know you thoughts.

    3. Will it create a problem with my I751 pending application even though my marriage is in good faith and my wife is with me and she ready to do whatever it takes? let me know your thoughts.

    4. Will this diversion and my dismissed charges will create a problem will my N 400 in future. I am eligible to apply after april 2004
    but I am going to wait till i complete my diversion in august 2004 so that my complaint gets dismissed.
    Will my arrest or detaintion will create a problem in N400 even though charges/complaint were dismissed.

    5. Will this offense will go against my moral character and they will reject my N400?

    6. if they reject my 751 or n400 based on this dismissed offense, what are the options i will have ?

    7. I talked to one attorney and I don't know whether she know about all this criminal and immigration laws or not, but she told me that
    don't travel and don't file for n400 for next 5-6 years. She just told me to stay here and wait for 5-6 years before I do anything. she even if you get interview for 751 or if you get approval and you have to go to INS for fingerprint then don't go alone and always take attorney. I am also worried about my N400 and my travel outside USA.


    I even cancelled my trip because of all this information.

    Please share your knowledge on this one and whatever information you have regarding this issue.
