I just wrote this on a thread, but realized it could be helpful to quite a few people:
I called the 1-800 # of the IRS today and spoke to a very nice man about ITINs. He informed me that an undocumented alien can file for a tax return. Anybody who has lived in the US for a certain time period is considered a US resident for tax only purposes. You first have to fill out a form W-7, which you can fill out and print from http://www.irs.gov. You will also need a copy of your passport. If you do not have a passport, than you will need two forms of ID. You can use a US driver's license, a foreign driver's license, a foreign voter registration card, a foreign or US military identification card, a birth certificate, any other ID issued by the US government or a wide variety of ID's issued by a foreign governement.
You must send either notorized copies or originals with your for W-7. You must staple the form W-7 to the front of your completed tax return (leave the part asking for your social security number blank). You can mail this packet to the address listed in the instructions of the W-7, or you can personally bring it to a local IRS office. They will verify and return your documents (if you bring originals) and forward your packet to be approved for an ITIN. Once your W-7 is approved (4-6 weeks), they will fill your new ITIN in on your completed tax return and forward it for normal processing (4-6 weeks). You will receive a letter in the mail with your original documents (if you mailed them) and your new ITIN #. You can use that # to continue to file returns in following years until you become eligible for a regular social security #.
