  • Husband left me before getting green card..

    We married in 2014 & he recently received his employment authorization about 2 months ago. His status at the moment is that we are currently waiting to get the date and time of our interview to receive his permanent residency. The thing is, my husband left me for another woman about a month ago and has moved out. He has made the decision to completely move on in his life but has not done anything when it comes to immigration or filing for divorce. What is the best legal action I can take at this point?

    So you petitioned him as a spouse and he is currently doing Adjustment of Status (but it hasn't been approved)? You can withdraw your I-864 Affidavit of Support so you won't be stuck with any obligations. Without the I-864 his I-485 can't be approved unless he does VAWA or something. You can also withdraw your I-130 petition. Note that withdrawing the I-864 and/or I-130 must be done before his I-485 is approved; otherwise it will be too late.
