What is the lifecycle/timelines of the Asylum application once pending infront of IJ

  • What is the lifecycle/timelines of the Asylum application once pending infront of IJ

    Came to US legally Jan 1991
    Asylum filed 1992
    Asylum Interview May 2001
    Asylum Denied August 2001 NTA refer to IJ
    Sept. 2001 Master Hearing
    IJ gave next date for May 2003 as individual hearing...
    What will happen now.
    Please evaluate My possible relief options and Advice? What will work best.
    1. Cancellation of Removal - 10 years, good moral character, both parents LPR, Parents filled for their Citizenship in 2001. Both parents old (60 years) and need occassional medical attention.
    2. Reopen Asylum!
    3. 245i petition pending - parents as LPR filed my I-129 in Dec. 1997. Visa date current 2B category once the parents become citizen in later 2003.
    4. Volunteer Depature.
    Next, what can happen if the IJ denies all - what is the procedure for BIA and appeals and the time lines...!

      You have many options for you. You should seek services of a good Immigration Attorney to fight this case. You have pending petitions also, you have different venues open for you. You should work closely with your Attorney.
