    Unfortunately he most likely will be deported.
    Final order of deprtation is very hard to reverse.
    I know a person with a final order of deportation, married to a USC, I-130 apporved who was still deported.

    Since you both two USC children then he should contact some good Immigration Attorney and apply for Cancellation of Deportation.

    well if you have 2 usc kids together than you need to marry him and file AOS for him. I presume you are a usc.
    Is he still detained at the INS facility ?
    I think any decision depends on why he was issued a deportation notice in the first place.
    You need to check with a very good lawyer.
    you said that he never received any reply for his appeal even if he filed for change of address. so what was he thinking by then ? That no decision was made yet and he was still waiting ????

    EVERYONE READING THIS, PLEASE HELP.

    MY BOYFRIEND WON A VISA LOTTERY FOR DV-2003. HE WAS TOLD TO COME FOR AN INTERVIEW ON JUNE 26, 2003. WHEN HE GOT TO THE INTERVIEW, HE WAS ARRESTED BY THE INS FOR FINAL ORDER OF DEPORTATION. HE HAS BEEN FIGHTING DEPORTATION WITH THE INS SINCE 1986. HE CAME TO AMERICA SINCE 1984. THE INS TOLD HIM THAT THE LAST APPEAL HE FILED WITH THE BIA WAS DENIED. HE DID NOT GET A COPY OF THE DENIAL FROM THE BIA. THE DENIAL LETTER WAS SENT SINCE MAY 2002. HE HAS MOVED FROM HIS RESIDENCE SINCE THEN AND ALWAYS FILED AN ADDRESS CHANGE TO THE INS AND THE COURT, BUT THE DENIAL LETTER DID NOT GET TO HIM.

    I SHOULD ALSO SAY THAT WE HAVE TWO U.S. CITIZEN CHILDREN TOGETHER AND AN APPROVED 1-360 FROM HIS DECEASED WIFE SINCE 1994 AND HAVE BEEN IN THIS COUNTRY SINCE 1984. HE HAS ONLY ONE CONVICTION IN 1988 FROM THE EMPLOYMENT DEVELOPMENT DEPARTMENT FOR RECEIVEING UNEMPLOYMENT WHILE STILL WORKING . HE HAS PAID RESTITUTION AND DID COMMUNITY WORK FOR THE OFFENSE.

    I WILL LIKE TO KNOW IF ANYONE KNOWS OR HAVE AN ADVICE ON WHAT MIGHT HAPPEN TO HIM. IF WE HAVE ANY CHANCE OF APPEALING TO THE COURT FOR STAY OF DEPORTATION.
