There is no bar for anybody to sponsor you. But may be you will have to go for interview in your home country because 245(i) is not extended yet. If it will be extended then you do not have to got to your home country.

if i have to go home to my country for te interview, wouldn't i be barred witht the 3/10 since i have overstayed my B1? please advise.

if you've overstayed your b1/b2 by six months youre barred from entering the country for 3 years. if you've overstayed by a year or more, its 10 years. how long have you over stayed?

i have overstayed for 1 year alredy. reason being that i got married to a USC who cannot apply for AOS due to lack of funds for affidavit of support. we tried to find help from his relatives, but they have all declined. anyways, our marriage has gone south na dwe might file for annulment. it is in this light that i am considering other options as i have sold all that i have back home. also, i have found a good job. please, if there is anybody who can enlighten me, do so, i'd really appreciate it.
