Does a F4 category qualify for CSPA,
The priority date of the case is : May 01 2002
The Petitioner applies for her sister the applicant. The applicant has two children whom at the time of filing were under 21 years of age. The children were under 21 years of age as well at the time when the application was approved as well.
They recently sent a visa interview to the applicant to present at the embassy. I email the embassy to request that the children be included in the petition. Some people at the embassy said yes they can come to the interview appointment an some people said no they are not qualified.
MY QUESTION: Are they qualify or not under this provision, the CSPA benefit ? IF not why? if Yes, Why?
