i-485 query

    Hello,

    My wife and I had our interview this morning at Chicago. Our apt was at 9:30 am, the IO was pleasant but we were questioned for about 45 minutes. a little back ground about us, we got married in January 2014, but have been dating since 2011. We also live in different states for now due to work/education.
    We had plenty of evidence such as:
    joint bank accounts
    401k beneficiary info
    stock options together
    phone bills
    internet bills
    photos

    I was involved in an motorcycle accident in India in 2001 and I was never arrested , the case went thru the court due to the fact that a person was injured and finally the case was closed. The IO wanted to know if that case was indeed closed. It most definitely is as I came here in 2005 on a F1 visa after obtaining the police clearance certificate.

    I request the members of the forum to please let us know that if this would be reason for denial of my I-485 petition. Also how long will a background check take to find out that the accident case is indeed closed?
    Should I obtain a police clearance certificate and be prepared for the RFE?

    At the end of the interview, the IO told us that he will review our petition as well has make sure that the accident case is not open and then make a decision.

    Appreciate any/all advice.

    The officer might request information from your consular file if you told him that you got a PCC when you filed for the F-1. If anything, he will request evidence that the case is closed. You might need to get a PCC as well as evidence from the courts that the case is closed. Wait until the request before needlessly requesting documents from India. You never know, they may just approve the case.

      Thank you for your response.

      We will wait and see if USCIS will issue an RFE and accordingly act. I got my I-130 approved yesterday btw. Stil waiting on the I-485.
