  • I 824 approved but concerned!!!!!!!

    Hi to experts Michael and Jo

    My son is possibly now protected under Sec 3 of Child Status Protection Act.

    For the benefit of others here is case so far


    To Follow to join- Child date of birth 22nd April 1981

    1. Husband filed I 140 9th Sept 00 approved 2nd May 2001

    As myself and middle son were resident in the UK at the time husband was advised to complete I 824's for us. We were to follow to join once son finished his degree. We were not allowed to complete I 485's so;

    2. In Dec 01 husband sent I 824's (prior to sons 21st) this was still pending at the date the CSPA came into being. This came back denied in Oct 2002 advising to send another I 824 once husbands I 485 was approved.

    3. In Feb 2002 husband applied for I 485. This was approved 13th April 2004

    4. Husband sent 2nd I 824 for son 20th May 2004 This has just been approved on 9th Aug 2004


    I am scared because I have asked Texas and the American Embassy if he is protected. The e-mails I have back are:

    TEXAS said He has aged out as no I485 was submitted for son

    Americam Embassy said He has aged outdue to section 424 of the patriot act

    Now Texas has approved I 824 does anyone know if London can revoke it??????????
