    Hi,

    I have a question regarding immigrant visa.

    A woman entered the US w/o inspection. She got caught at border, and went back to home country on voluntary departure basis. However, she overstayed several months over the departure date. She now can apply for an immigrant visa because her sister, US citizen, applied for the immigration benefit sbout ten years ago.

    Do you think it is still possible for her to get
    the immigrant visa?
    Does she need to file a waiver?

      A waiver is still needed but is only available to immediate relatives.Brother-sister relationships are not a qualified classification for the waiver though.

      I HIGHLY suggest speaking to an attorney.
