  • Adult inmate facing deportation finds out he may be a citizen by birth--Questions!

My fiance is in prison for a 13 year state sentence. He was previously deported in 1996. He has an INS hold on him on his release.

He has found out that his natural father is a US citizen and is not the man listed on his birth certificate. This has been proven by DNA testing. He would have filed for citizenship based on this had he known about it earlier. He is 27 years old now.

How does this effect his deportation? Doesn't the fact that his father is a US citizen make him a US citizen also?

Thank you for any information or help you can give!
