  • Military baby, here illegally?

    Hello,

Hoping someone can help me answer my 3 questions. I am helping a friend research this.

If someone was born outside the US at a civilian hospital and their father was military but the mom and dad were not married, does that make a person a US citizen?

How can someone find out if they are a US citizen?

If someone is here illegally what is the first step to gain US citizenship? (They came on a temporary visa but ended up staying here for over 30 years).

Well it depends on when the child was born and you will need to find a sponser for the illegal part or be a good person and leave

What year was the child born?
        Where was the child born?
Did the father legitimize the child by affiming that it was his child or marrying the mother?
The child would seem to be a USC but he would have had to have been legitimized before he was 18/

As I recall, the USCIS website has a description of the laws regarding this situation in effect at various times. The year your friend was born determines which law applies.
