Question on K3

I got married outside US and I had applied I-130 as LPR for my spouse back in October 2001. Now I became USC this month. I am trying to find out the fatest way to get my spouse here. My understanding reading and talking to the people as follows:

1. I can file for an upgrade of I-130 from LPR spouse to USC spouse
2. I can file for K3 meanwhile

If someone have similar case can answer my following questions than that will be highly appreciated.

A. To file an upgrade what form I will need to fill out or what is the procedure? How long it will take to get the approval for the I-130 after I filled the upgrade at VSC?

B. If I file for K3 at the same time then how long K3 are taking these days for the approval? What is the process after my spouse come here on approved K3 i.e what will happen to my I-130 after K3 approval? Do I need to file AOS when my spouse is here on K3 or upon I-130 approval my spouse will get the GC? If so can we do it here or she needs to go back to the country of origin.

I don't know anything about your first question (A). The length of time for K-3 can vary. You can check the processing times for the Missouri Service Center for the 129f. Then it is according to how long it takes the consulate you have to go through to process the paperwork and get the interview completed, etc. Some have been going through very fast (2-3 months), others take close to a year I think. Normal procedure would be to file for AOS once your spouse is here. If you go to www.immigrate2us.net there is a whole section devoted to K-3 and AOS, etc. Hopefully someone will respond who knows about upgrading your status for the I-130.
