EXPEDITE PROCESS??

    If you have filed to adjust your status you can obtain an advanced parole to enable you to leave the U.S. and still apply to reenter the U.S. without having your application denied for abandonment. If you are an LPR and are waiting on naturalization there is no issue, unless this trip will place you over the limit for time outside the U.S. If not, then go ahead and travel.

    As far as I can tell nobody in the US is stopping you leaving.

    Advanced Parole is certainly something to consider if applicable. Should be OK, I used it several times. Assuming you have not overstayed sufficiently to be subject to a ban.

    You might be a ble to get an expedite on that, begs the question why you did not apply for it with AoS. A moot issue now.

    why do I suspect that the OP is a visa cheat? Someone who arrived in the US with a tourist visa (having lied to get it), then lied to our border officials about how long she was going to "visit", then found some dodo to marry and now is all concerned that her lies and BS will catch up to her...once again for the intelligence impaired...you can easily leave MY country anytime...no one will stop you.

    You did complete the I-131, Application for Travel Document along with your I-485, correct? I understand your concern regarding Advance Parole. You are right. There are no guarantees there won't be problems re-entering the US while traveling in that status.

    what im afraid of is that they will give me a advance parole to leave instead of giving me the greencard that i've been waiting on.
    My lawyer suggested in the beggining to rather wait for my greencard then take advantage of the advance parole, because there's always a slight chance that i will run into problems coming back to the US.

    Hopefully, they will allow you the opportunity to visit your ailing father. I know they can be quite harsh. It might be a good idea to involve your congressmen sooner than later. It couldn't hurt.

    Thanks ProudUSC, I still have to wait on immigration to decide if they're willing to expidite it or not, if not, I'll get in touch with my congressman, I have no clue if it helps or not, but I have to try everything I can. I know that my case will be resolved and eventually get my greencard, because i've submitted what they needed its just a matter of time but time is a very sensitive issue right now, and running out of it. and that's what I want uscis to understand and put themselves in my position.

    so you're saying my Dad's dying is not a "valid" reason? I'ts not enough reason to see him for one more time, obivously i 've filed for I-485 to be able to stay here not to just leave and not be able to come back.

    Theone, I maybe wrong but I think it's more about being able to get back into the US without problems. The OP may be able to confirm that.

    From what I read, due to her situation (status) here in the US (or rather was her situation unless changed) it may be risky to leave the US whilst her case is pending.

    My guess is that the OP wants to know if she can get her case expedited quickly so she could leave the US to return home to her sick father and not have to worry about being refused re-entry if paperwork is not in order.

    That is how I understand it, but anything could have changed since her last post here on the board.

    Well said some people dont read the posters previous posts to know what situation/status the poster is in before they post a sarcastic reply as i have received a few myself.

    Dealing with Immigration can be a slow stressful process . So nice to see the genuine kind responses and posts on this site that i have read and some people are anti immigration especially now as the USA is experiencing some tough economic times .And jobs are hard to come by not as plentiful as in years past.

    AS it says in the bible "let not he/she cast the first stone" or be so fast to condemn others .


    Remember a lot of Immigrats help made this country strong. Never give up or keep smiling :-)

    And yes we all know where the Airport is ...before I get a smart comment LOL .
