Deportation after prison term

My brother-in-law is currently serving a 2 year prison term for assulte.. His parole date is August of this year.. We are told that there is a " Immigration hold" on him.. I have a couple questions regarding this.. Keep in mind he is COMPLETLY illegal..
1 - What happens in August and the day comes to leave prison?

2- He has 5 young girls that if he gets deported he will therefore not be in their lives.. What, if anything can be done so he can still be in their lives?

Give him a cell phone and a phone card. Or, have them return home with him.

1. As he is released from the prison's custody, ICE will take him. He will be jailed until his bond hearing with the IJ. It is likely that he will be held as an ag-felon throughout his hearing. It may end with his deportation.

2. If they are US citizen children, he may be eligible for a hardship waiver... but probably not because of his criminal record. If he is deported, they can maintain contact through the wonders of modern communications or go and visit him in his home country.

Perhaps maybe I should learn proper english OR maybe I could learn a thing or 2 from all the men in my family that has served in some branch or another of the U.S. military about what we as AMERICAN BORN AND RAISED CITIZENS tolerate. Because obviously we do not tolerate criminals or illegal aliens. That is why my BIL is being deported.. Um so Hello again go back to the original post and READ carefully...VERY CAREFULLY ... I don't think its too much of a strectch to make the correlation that you're asking for possible way for your bro-in-law to stay in this country, considering you're asking for all possible avenue on how he can be in part of his children's lives when he's deported, as well as checking into the procedures that'll be applied on him once he's released on jail.

Ironically, illegals often have better chanes than LPR in those deporation hearings. If you get a good attorney doing post conviction reliefs, your brother in law might well stay on a waiver.
