I need help,please. I am from California my husband is in ICE custody in New Mexico. I am on Social Security and dont have money for an attorney. I filed a I-130 for him in 2001. He was accepted in 2005. The Judge set a bond of 6,500. I cant post the bond he has no criminal history, I have a terminal illness, I need my husband for support emotionally and finaciay. What are the chances that the judge will release him on an "OR", or whats next???

hi mbenitez, sorry to hear that about your husband . can you please give more details about your case. how did your husband enter the country ? was he legal or illegal? if illegal how long he was in the country before the arrest? and why hes been detain now ? give us more details please

you said you filed the i130 in 2001 and it was approved in 2005. Did you file the petition before april 30,2001? If so, did you file for the adjustment of status form I-485A supplement and pay the $1,000.00 for the amnesty. He was eligible under 245I.
Mike has listed some pro bono lawyers for you. Contact them ASAP. Get the proper paperwork in order and concentrate on documents and resources.

Why are you so angry? Sorry my husband can't getdeported he is not eligible for deportation. I have rights and so does he. Immigration judge lready said no deportation and the government attorney agreed...so stop being so harsh...why not wish good on other people, thats why things and life is the way it is no consideration for other peoples pain. We all bleed the same color, we all have a face and two eyes...good luck to you my friend. God Bless you.

First, I want to apologize for my post yesterday. I deleted it and didn't mean to be ugly. Other things going on in this forum got in the way. So, is your husband still illegal? You said he was approved in 2005, right? He is a legal resident? So, I don't understand why he is in ICE detention. Can you elaborate so we can help? Perhaps a timeline of events will help us understand the circumstances better.
