    I'm pretty sure (I'm not a lawyer) that there's a recent law--last year or so--allowing a substitute petitioner in the instance you describe.

    I AM AWARE OF THINGS TO DO IF U.S. CITIZEN SPOUSE DIES WHILE AFTER PETITIONING FOR ALIEN SPOUSE. BUT WHAT IF CITIZEN OR RESIDENT MOTHER DIES WHILE PETITIONING FOR ALIEN SON? DOES PETITION FAIL IF SHE DIES BEFORE HE COMES TO U.S.? IS HE OUT OF LUCK UNLESS SOMEONE ELSE CAN FILE A NEW PETITION FOR HIM? I GUESS EVEN IF THAT'S THE CASE, HE LOSES HIS PRIORITY DATE?
