I-751 & choosing to move back to home country...

I have to file an I-751 soon in order to maintain my PR status in the United States. I am currently not working (expecting a child in October) and do not have plans to work in the States from now on. I am moving with my husband back to Canada next February as well.

My questions are:

1. Should I bother re-newing my PR status if it will only be active for less than six months?

2. How does it affect my ability to go back and forth between Canada and the United States once my PR status expires? Will I be able to go home to visit family in November (PR status would need to be renewed at end of August) and then return to the States after the visit?

Are you a Canadian Citizen?

You may want to call US Consulate in Canada at (416) 595-1700 and ask how would it affect your future non-immigrant visits to US if you held GC in past but later voluntarily abandoned it.

Thanks...I am a Canadian citizen. My concern is that we will be living in the States until February but I don't want to have to pay the fee to stay for only six months...is there another option, like a visitor's visa or something?

Hi canusa,

So, your conditional status is good until the end of August?

There are consenquences for not filing to remove conditions. It may affect your future visits to the US ( USCIS may order removal proceedings against you, and you may not even find out about it before you move). Since you'll probaly be visiting and may move back one day, I would say it is well worth "bothering", so you don't leave something like that hanging in the air.

You can also explore the idea of going to Canada now, abandoning PR and returning as visitor...

It is not only question about abandoning PR status ( which per se does not have consequences on future non-immigrant visits), but when to do it and what to do in the meanwhile.

Thanks to you both....I know its not a ton of money, it just seems so silly for only six months.

But if its going to affect my future visits, then I definitely want to file the paperwork. I'll call the consulate today though to double check, thank you!

In this case I don't know the exact answer so advised the OP to contact both US Consulate in Canada and Canadian Dept. of Consular affairs in US to get more accurate information, but you are a ****sterhead who usually pretends to know and gives wrong advises while you know nothing.
